Biography
Since 2009, Maxey Scherr has litigated countless jury trials resulting in multi-figure verdicts and settlements across the board. In 2022, she founded Scherr Law Firm. Her areas of expertise include truck crashes, traumatic brain injuries, wrongful death claims, product liability in truck crashes and non-obvious third-party defendants. Ms. Scherr is licensed in Texas, New Mexico and Illinois and graduated from Texas Tech School of Law. After she earned her bachelor’s degree in psychology from the University of Massachusetts-Boston with magna cum laude honors, Ms. Scherr undertook postgraduate work in Neuroscience at Harvard University. Board Certified in Truck Accident Law by the National Board of Trial Advocates and Personal Injury Law by the Texas Board of Legal Specialization, Ms. Scherr has extensive experience in her specialty, undergone rigorous examinations, is supported by the reviews of peers and judges, and demonstrates an unwavering commitment to the advocacy of her clients and justice.
Ms. Scherr currently serves as the Academy of Truck Accident Attorneys (ATAA) Board Secretary and is on the Board of Regents after formerly serving as Board Parliamentarian and Women’s Caucus Co-Chair. At the American Association for Justice’s Trucking Litigation Group, Ms. Scherr is on the Executive Board, is the Education Co-Chair, and manages the Broker Database. For AAJ’s Traumatic Brain Injury Litigation Group, Ms. Scherr serves as the Brain Injury Association of America Liaison and Diversity & Inclusion Committee Chair while still maintaining an active role in the Women’s Caucus. Ms. Scherr sits on the board of the Rules of Evidence Committee for the State Bar of Texas. Widely recognized as an authority in her field, Ms. Scherr frequently presents to fellow attorneys and publishes thought-provoking articles discussing key trucking and brain injury issues. Ever the passionate advocate, Ms. Scherr can be found lobbying for heightened trucking safety and finding ways and means to increase awareness concerning brain injury matters.
In her hometown of El Paso, Ms. Scherr is a Downtown Management District Board Member and Women’s Rights Commission Member. In 2023, Ms. Scherr launched the Scherr Law Firm Scholarship and Internship Program for local high school students considering a career in the legal field. Every summer, her firm also offers a clerkship to promising students pursuing a degree in the legal field.
Most recently, Ms. Scherr was honored by TopVerdict.com after successfully obtaining TWO Top Five Verdicts and TWO Top Five Settlements in the State of Texas. In the larger United States, she also received recognition for a Top 10 Truck Accident Settlement, a Top 20 Truck Accident Verdict and TWO Top 20 Occupational Injury Verdicts. She is also a co-founder of the All-Women’s Trial Lawyer Association and Of The 8, Inc. and spearheads several other noteworthy programs. Known for her integrity and work ethic, Ms. Scherr is honored to be a part of the Melvin M. Belli Society and the International Society of Barristers.

Notable Results
- Scherr Law Firm Secures $10.65 Million Verdict In Firm's First Trial., The plaintiff, a 28-year old Swift Transportation female truck driver, suffered a permanent traumatic brain injury, among other medical conditions, when a semi-trailer door came crashing down on the back of her head on September 27, 2017.
- Sought damages for a minor child who suffered a traumatic brain injury., Previous attorney was unable to get case resolved at low five-figure amount before case was transferred to Maxey Scherr. After Ms. Scherr began working this case, the defense hired a multitude of experts to defeat the claims. Ultimately, this was unsuccessful for the defense and case concluded in a confidential large settlement.
- Litigated against a major trucking corporation in which the driver caused a multicar collision., Concluded in a confidential large settlement and admission of gross negligence by trucking corporate representative once egregious falsification of log issues exposed and uncovered by Ms. Scherr.
